(Protection of Personal Information Act)

Introduction:

Clovelly Country Club (“we”, “us”, “our”) is committed to protecting the personal information of members, guests, employees, suppliers, and other stakeholders. We comply with the South African Protection of Personal Information Act (POPIA; Act 4 of 2013), effective since 1 July 2021, which governs lawful processing of personal data.

Responsible Person

We have appointed an Information Officer responsible for POPIA compliance. You may contact this person for requests regarding access, corrections, withdrawals of consent, complaints, or other data-related inquiries.

Information We Collect & Purpose

We collect only what is necessary, from channels such as online booking forms, membership applications, emailing newsletters, event registrations, and employment records. Categories include:

  • Identity details: name, ID/passport, membership number

  • Contact information: email, postal address, telephone

  • Transactional data: membership payments, green fees, event attendance

  • Marketing preferences: opted-in communications

  • Website analytics and cookies: browser details, usage data

Purposes include: processing bookings and memberships; communicating club news, events, and specials; marketing; compliance with legal requirements; security and fraud prevention; and enhancing service delivery.

Legal Basis for Processing

We process your personal information under POPIA on lawful grounds, such as:

  • With your consent (e.g. when signing up for newsletters or events)

  • To fulfil contractual obligations (e.g. membership agreements, bookings)

  • To comply with legal requirements (e.g. tax and safety laws)

  • For legitimate purposes (e.g. fraud detection, service improvement)

Consent, Marketing, and Opt-Out

On subscribing to newsletters or event notices, we will:

  • Clearly inform you of the use of your personal information

  • Obtain active consent

  • Provide an easy method to withdraw consent or opt-out of marketing at any time

Sharing and Third Parties

Your personal information may be shared with:

  • Service providers (e.g. payment processors, IT support, cloud hosting) under strict confidentiality

  • Authorities (e.g. tax, safety regulators) if legally required

  • Third parties, only with your explicit consent

We ensure that third parties uphold data protection standards consistent with POPIA.

Data Security

We implement reasonable safeguards (SSL/TLS encryption, secure storage, restricted access) to protect personal data both in transit and at rest. Access is limited to authorised personnel only.

Retention and Deletion

We retain personal information only for as long as necessary:

  • Membership and booking records: for legitimate business and legal periods (e.g. tax retention − typically 5 years)

  • Marketing records: until consent is withdrawn

  • Once no longer needed, data is deleted or irreversibly anonymised

Cross‑Border Transfers

If data is transferred outside South Africa (e.g. cloud storage abroad), we ensure POPIA-compliant safeguards are in place or obtain your consent.

Your Rights Under POPIA

You have rights regarding your personal information:

  1. Right to be informed – about what data is collected and why

  2. Right of access – to request copies of your personal data

  3. Right to correction/delete – if data is inaccurate or no longer required

  4. Right to object – to processing based on legitimate interest or direct marketing

  5. Right to withdraw consent – at any time

  6. Right to lodge a complaint – with our Information Officer or the Information Regulator

Data Breach Notification

In the event of a data breach, we will notify:

  • The affected individuals without undue delay

  • The Information Regulator, where required under POPIA.
